by commissioning the artist, you are agreeing to the terms of service stated below:
I. GENERAL✦ My terms are subject to change without notice
✦ All drawings may or will include a subtle sign that you may not remove
✦ Prices are subject to change based on demand
✦ Please provide visual references and detailed descriptions of the art you want
✦ Ill behavior will not be tolerated and the commission will immediately be terminated (see point 6 further below for more info on termination)
✦ I have the right to refuse any commission based on content, subject, untimely deadlines, or other reasons such as a poor state of health, or any other notice
✦ No rushing of commissions. Give me time to finish as it depends on the complexity
✦ My work won't likely look like the reference as I work on my own art style
✦ I may use commercially licensed, copyright-free, and/or other materials, assets, and tools in creating the commission
✦ I will post watermarked or glazed versions of the commissioned artwork to prevent theft and AI scapingII. PAYMENT✦ Commissions can be paid either 100% upfront or split 50% upfront and 50% after completion
✦ Don't send me any payment before I have agreed to give you a slot and request you send me the payment
✦ I only accept slots done on a first-come, first-served basis
✦ Personal use only. Commercial use will double or triple the priceIII. PROCESS✦ Work will start once payment is sent
✦ I will notify you when I have started on your commission and you, therefore, lose the rights to a refund (see point 6 further below for more info on refunds)
✦ I'll be checking in at the sketch and rough coloring stages and won't continue until you approve and/or request minor changes if applicable
✦ All payments should be first completed before file delivery
✦ The turnaround time will be more or less 5 days to 1 month and a week depending on the following circumstances:a. Order of your commission
b. Personal IRL problems
c. Health problems
d. Complexity of the commission
e. Untimely events
You will be informed if any of these occurIV. REVISIONS✦ You get 5 rounds of changes on the commissioned piece included in the price
✦ A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made
✦ If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and the hourly rate
✦ Total rework on the final verification will cost 100% of the original price
✦ If your reference is unclear to start with, changes will come at an extra chargeV. COPYRIGHT/USAGE POLICYI, d.vent, claims the rights to the produced drawing, not the buyer.Unless an NDA has been agreed upon, I am allowed to use the copyrighted artwork to:✦ Promote myself with it everywhere
✦ Publish books with it (artbooks, etc.)
✦ Display it everywhere to my liking (website, social media, etc.)
✦ Post it wherever I wantThe buyer is allowed to:✦ Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
✦ Print the artwork and claim the character(s) as their own, but not the artwork itself
✦ Use the artwork to promote themselves. You must credit me using my social tag/username/link at the instance of display of the commissionThe following is considered copyright infringement:✦ Reproducing/using the copyrighted artwork commercially - means making money off it in any way - when it was paid to be for personal use
✦ Claiming the artwork as your own
✦ Removing my signature from the artwork
✦ Altering the artwork without my consentVI. REFUND/TERMINATION POLICY✦ The buyer is not allowed a refund once I start working on the commission
✦ If for any reason I am unable to start your commission, you will receive a full refund
✦ If you cancel your order before I start it, you can get a full refund.
✦ If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself
✦ If you request a PayPal chargeback at any point when you were not allowed to ask for a refund you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again
✦ If a commission is terminated, you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way
✦ Termination of the commission will only be in effect if the following occurred:a. The client has violated or breached the artist’s terms of service
b. The client has essentially ghosted the project of their commission after no communication for 3 weeks or more
c. The client fails to complete the commission payment/delays the payment to an unreasonable time frame
d. The client exhibits ill behaviorVII. ARTIFICIAL INTELLIGENCE/NFT✦ You shall not reproduce and/or otherwise use the commission in any manner for purposes of training artificial intelligence technologies to generate work, including without limitation, technologies that are capable of generating works in the same style or genre as the commission. Nor shall you sublicense others to reproduce and/or otherwise use the commission in any manner for purposes of training artificial intelligence technologies to generate work
✦ All commissioned pieces, under any circumstances, are strictly prohibited from contributing to AI or NFT redistribution or reselling. Commercial usage does not cover reselling, redistribution, or ownership transfer for AI art training and NFT
✦ I prohibit the use of any form of AI generative models in creating any part of the commission
